About these terms

These terms apply to your use of manxliving.com (the "Site"). The Site is operated by Clay Limited (company number 131431C), Hillary House, Prospect Hill, Douglas, Isle of Man, IM1 2EQ.

By using the Site, you agree to these terms. If you don't agree, please don't use the Site. Our Privacy Notice and Cookie Policy explain how we handle personal data and browser storage. Agreeing to these terms does not give consent to optional cookies or marketing.

We may update these terms from time to time and identify the effective date of the published version. Material changes will be explained where appropriate. Continuing to use the Site after a change means you accept the updated terms, subject to your mandatory legal rights.

What ManxLiving does

ManxLiving is a property-information portal. Properties are supplied by participating estate agents and other approved advertisers. We are not the selling or letting agent for any property listed, and we don't negotiate or enter into the transaction between you and an advertiser.

Listing information may change, and may contain errors. Before you rely on a listing or make a decision, confirm availability, price, tenure, measurements, condition, location, services, planning matters and every other important detail directly with the relevant estate agent. Nothing on the Site is legal, financial, surveying, valuation or property advice.

Listings and advertising standards

Estate-agent listings are advertising and must comply with applicable advertising and consumer-protection requirements, including the CAP Code where it applies and the Isle of Man’s Consumer Protection from Unfair Trading Regulations 2019. The CAP Code’s definition of the United Kingdom includes the Isle of Man.

Estate agents are responsible for making sure their listings are accurate, substantiated and not misleading.

If you believe a listing breaches these standards, please use Contact to tell us. We'll review it and may amend, suspend or remove a listing, or an advertiser's access to the Site, where reasonably necessary.

Estate agents and advertisers

Estate agents and other advertisers are responsible for having the authority to advertise a property, for the accuracy and legality of their listings, and for complying with applicable consumer, property and data-protection law.

Enquiries and accounts

An enquiry sent through a property listing is routed to the relevant estate agent. Sending an enquiry doesn't create an agency, sale, tenancy or other property contract with us.

If accounts are available, you must be 18 or over to register one. You must provide accurate information, keep your credentials secure, and tell us promptly if you suspect someone else has used your account without permission. Saved properties and account preferences, where available, are convenience features — please keep your own copy of anything important.

Acceptable use

You must not:

• break the law, or infringe another person's rights;
• try to gain unauthorised access, bypass security, or disrupt the Site;
• introduce malicious code, or use our forms for spam, harassment or false enquiries;
• scrape, copy or republish a substantial part of the Site or its underlying database without our permission or another lawful basis;
• misrepresent who you are, or your relationship with us, ManxLiving or an advertiser;
• reproduce, duplicate, sell or otherwise exploit any part of the Site for commercial purposes beyond your own personal property search, without our written consent;
• reverse engineer, decompile or disassemble protected parts of the Site except where applicable law or a software licence permits this;
• remove any copyright, trade mark or other proprietary notice from the Site or its content;
• frame or mirror any part of the Site without our prior written consent.

We grant a limited exception to operators of public search engines, so they can index the Site for their public search service. We can withdraw this exception at any time, generally or in a specific case.

We may restrict or suspend access where reasonably necessary to protect the Site, our users or others, to investigate misuse, or to comply with the law.

Intellectual property

The Site's software, design, branding and content belong to us or our licensors. Advertisers or their own licensors keep the rights in listing text, photographs and other material they supply. You may use the Site for your own personal property search, but may not reproduce or commercially exploit protected material without permission or another lawful right.

Links

The Site may link to other websites. We're not responsible for, and don't endorse, those sites, and using them is at your own risk.

You may link to the Site provided the link is fair and legal, doesn't suggest an endorsement that doesn't exist, and isn't harmful to our reputation or that of our affiliates. We can ask you to remove a link to the Site at any time, and you must comply promptly.

Availability and our responsibility to you

We aim to keep the Site available, useful and secure, but we don't promise it will always be available or error-free — for example, we may need to carry out maintenance or upgrades. We may change, suspend or withdraw features.

We provide the Site on an 'as is' basis, and to the extent the law allows, we don't make promises about its completeness or accuracy beyond what's in this document and our other policies.

Nothing in these terms excludes or limits liability where doing so would be unlawful — including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our negligence — and nothing here limits any right you have as a consumer under Isle of Man or other applicable law that can't lawfully be excluded.

Ending your access

These terms apply for as long as you use the Site. We may restrict, suspend or end access where reasonably necessary for the reasons above. This does not affect any right or remedy that cannot lawfully be excluded.

Governing law and disputes

These terms, and anything arising from them, are governed by Isle of Man law, subject to any mandatory right or forum available to you as a consumer under the law of the place where you live.
